Background

We respect Your privacy. It is important to us that You have confidence in us regarding how we work to protect Your privacy.

This policy (”Privacy Policy”) has been established in order to ensure and make You aware that Car Info Nordic AB (”Car Info”, ”we”, ”us”) Processes Your Personal Data in a legal, appropriate and safe manner when You (i) visit our web page www.car.info (the ”Website”) or our app (the ”App”), (ii) purchase or use our services or products at our Website or App, or (iii) are in contact with us in some other way. This Privacy policy also contains information about what applies to You who become or are a member of our login-service and therefore also describe the way we Process our members’ Personal Data. In addition to this Privacy Policy, our terms of use apply for our members.

Publishing Certificate

Car Info holds a certificate of no legal impediment to publication (“Publishing Certificate”) for the Website, issued by the Swedish Broadcasting Authority. The Publishing Certificate means that Car Info has a constitutionally protected right according to The Fundamental Law on Freedom of Expression to publish the Website. This in turn means that Personal Data published on the Website does not have to comply with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) or supplementary national legislation (collectively referred to as the “Data Protection Rules”). However, the Personal Data You provide to us when registering an account and which we Process when marketing our business to You must comply with the Data Protection Rules. This Privacy Policy therefore explains, in accordance with the Data Protection Rules, how we Process Your Personal Data regarding Your user account, when You contact us and when we market our business to You. Even though it is not a requirement under current legislation, this Privacy Policy also describes how we Processes Personal Data covered by our Publishing Certificate.

Definitions

In this Privacy Policy, the term "personal data" refers to any information which can be attributable to an identified or identifiable natural person, such as e.g., name, address, personal registration number, date of birth, credit/debit card number, e-mail address, phone number and IP-address (“Personal Data”).

This Privacy Policy describes how we Process Your Personal Data. The term "processing" refers to e.g., that we register, store, send, and in other ways use Your Personal Data in the manner described in this Privacy Policy (“Processing”).

Data Controller

Car Info Nordic AB, Reg. No. 556953-9413, with address Lärkgatan 5, 262 32 Ängelholm, is the data controller for the Processing of Your Personal Data.

Why do we Process Your Personal Data?

Car Info only Processes Your Personal Data for specific purposes. This entails that Personal Data is Processed in order to:

  • provide products and services and in other way fulfil the agreement entered into with You when registering an account with us,
  • provide our services via our Website and App and to administer, develop and to improve the Website or App,
  • enable general customer relationships management (quality management, statistics, market and client analyses, as well as business and methodological development) and customer service and support, e.g., when You contact us via e-mail, phone, social platforms, our Website or the App,
  • leave information regarding events, send out newsletters and offers and address marketing information via e-mail or via social media platforms regarding our business and our services;
  • administer participation in competitions and events,
  • prevent fraud and carry out risk management; and
  • comply with applicable legislation.

We only collect Personal Data that is necessary for purposes described in this Policy. What Personal Data we collect and Process depends, inter alia, on which of our services You have requested, ordered or purchased or how you come in contact with us.

Car Info collects Personal Data about You when You use Car Info’s services, e.g., when You register a user account, visit the Website or App, when You who have a professional user account make a purchase, when participating in competitions and events and when You contact Car Info via our customer service.

In addition to the Personal Data You provide to us, or that we collect when providing our services, we may also collect Personal Data from third parties. These third parties vary from time to time but include inter alia suppliers of authorities providing us with information about vehicles, such as The Swedish Transport Agency and The Swedish Police, as well as insurance companies and other partners.

When You are asked to provide us with Personal Data, e.g., upon the purchase of a service, You may choose not to do so. If You choose not to provide us information that is necessary to access a particular service, this may lead to You not being able to complete Your order, or to us not being able to fulfil our commitments towards You.

What Personal Data is Processed by Car Info and on what legal ground?

The Personal Data listed below is Processed by us when You use our services or ask for our products:

  • Registration number or other information on vehicle ownership,
  • Login details, consisting of first and last name, e-mail address and password,
  • Gender,
  • Payment information, in case You register an account as a professional user,
  • Information about correspondence when contacting our customer service, as well as about any complaints.

The Processing of Personal Data is necessary in order for Car Info to provide You with the services/products You have requested. In situations when You visit our Website or register an ordinary user account, we Process Your Personal Data based on our legitimate business interest in providing You with our services. In the event that You register a user account as a professional user, You will enter into an agreement with us regarding the purchase of our services. Our legal basis for the Processing of Your Personal Data in these cases is the fulfilment of the agreement that has been entered into with You.

The Personal Data can also be Processed for upselling, e.g., providing You with offers for benefits such as discounts, general and personal offers, invitations to events, gifts or other direct marketing that we believe You may be interested in and which are advantageous for You. Such Processing of Your Personal Data is based on our legitimate business interest of being able to provide You with beneficial offers and a better user experience. For this Processing, we have conducted a balancing of interests where we have, inter alia, taken into account that the Processing does not include any sensitive Personal Data and that we have a clear commercial interest in being able to market our products and services to You as a customer in an effective manner.

When you contact our customer service, the Processing of Your Personal Data is necessary for Car Info to be able to provide a good service and to be able to investigate any complaints, and thus satisfy our legitimate interest of handling customer service matters and developing our business in an efficient manner.

We may also Process Your Personal Data with Your consent, e.g., when You consent to receiving our newsletters. You can always withdraw Your consent by contacting us. Upon such withdrawal, we will cease such Processing of Your Personal Data. Please note that we may continue to Process Your Personal Data based on legal grounds other than consent.

Your Personal Data is also Processed, in applicable cases, in order for Car Info to comply by its obligations stemming from applicable legislation, court rulings and decisions taken by the authorities. Such obligations may e.g., follow from the Accounting Act (1999:1078), or the Money Laundering and the Financing of Terrorism (Prevention) Act (2017:630).

Social media platforms

Car Info uses Facebook, Twitter, LinkedIn and Instagram as platforms to get in contact with customers, as well as market and inform about our business and our services. In connection with this, Car Info is the data controller for publications and information that contain Personal Data and are submitted by You as a user in the form of e.g., comments, photos and video clips. Car Info does not allow any offensive content to be published or made available on our platforms. We ask our users to report unfit content to us in order for us to ensure that such content does not occur. Car Info may also, based on what we deem necessary, remove content that has been published on our social media platforms.

How long is Your Personal Data stored?

Your Personal Data is stored only as long as is necessary in order to fulfil the purposes for which the Personal Data was collected in accordance with this Privacy Policy.

If You have a user account, Your Personal Data is stored for marketing purposes for 12 months after Your last interaction with the Website or the App. If You do not want us to store Personal Data for marketing purposes during this time, You are welcome to (i) contact us and object to this in writing or (ii) follow the link in the mailings.

If You have given Your consent to receive newsletters from us, we Processes Your Personal Data for that specific purpose until You unsubscribe or notify us that You no longer agree to receive newsletters sent to You. You can withdraw Your consent at any time by (i) contacting us and objecting to this or (ii) follow the link in the mailings.

Personal Data provided to us in conversations with customer service will be delated no later than 36 months after Your issue has been closed.

In order to ensure Car Info’s compliance with the legal obligations stemming from applicable legislation or in order to safeguard our legal interests (in the event of an ongoing legal process) we may store Your Personal Data for a longer period of time than what is stated above. The Personal Data is however never stored for longer than is necessary or statutory for each respectively purpose.

Your rights

You have a right to receive information regarding the Processing of Your Personal Data we carry out. Below You will find a statement of the rights You can claim by contacting us. Our contact information can be found at the very end of this Privacy Policy. 

Right to access

You have a right to, free of charge, request information regarding our Processing of Your Personal Data. You also have a right to receive a copy of Your Personal Data that we Process. Such a request shall be submitted to us in writing with a description of what information You wish to receive. We will respond to Your request without undue delay. If we cannot grant You access to the information Your request concerns, we will provide a reason as to why. The copy of Your Personal Data will be sent to Your registered address unless otherwise is agreed with You in writing. In order to ensure that the right person receives the information, we may come to request more information from You.

Right to rectification

The main responsibility to ensure that the Personal Data we Process is correct lies with Car Info. If You inform us that the Personal Data You have provided to us is no longer correct, we will promptly correct, block or erase such Personal Data.

Right to erasure

You have the right to request that Car Info, without undue delay, erases Your Personal Data. Personal Data shall be erased in the following cases:

  • if the Personal Data is no longer necessary for the purposes for which it was collected;
  • if You withdraw Your consent and the Processing was based solely on consent;
  • if Processing is carried out for purposes of direct marketing and You oppose Your Personal Data being used for such purposes;
  • if You oppose the Processing of Personal Data after a balancing of interests has been carried out and Your interest outweighs ours;
  • if Your Personal Data has not been Processed in accordance with the Data Protection Rules; or
  • if erasure is necessary in order to comply with a legal obligation.

There may be obligations which hinder us from immediately erasing all Your Personal Data. These obligations stem from applicable legislation regarding inter alia accounting. If certain Personal Data cannot be erased due to applicable legislation, we will ensure that Your Personal Data will be used solely for the purpose of complying with such legal obligations and not for any other purposes.

Right to restriction

You have a right to request that Car Info temporarily restricts the Processing of Your Personal Data. Such a restriction can be requested in the following cases:

  • if You consider the Personal Data we have about You to be incorrect and in connection with this have requested rectification;
  • when the Processing of Your Personal Data which is carried out is not compliant with the Data Protection Rules, but You still do not want Your Personal Data to be erased but rather restricted; and
  • when we no longer need Your Personal Data for the purposes of our Processing but You need it in order to establish, exert, or defend a legal claim.

If You have objected against the Processing of Your Personal Data, the use of Your Personal Data may be restricted during the time of the investigation. Upon the restriction of Your Personal Data, Car Info will only store Your Personal Data and for further Processing obtain Your consent.

Right to data portability

You have a right to, in the cases where we Process Your Personal Data with Your consent or in order to fulfil contractual obligations toward You, require that we provide You with all Personal Data we have about You and which is Processed in an automated manner, in a machine-readable format, which may be inter alia an Excel-file or a CSV-file. If it is technically possible, You further have the right to require that we transfer Your Personal Data to another data controller.

Right to object

You have a right to object to our Processing of Your Personal Data if the Processing is based on our legitimate interest. Car Info will in such a case ask You to specify which Processing You object to. If You object to any Processing we will only continue our Processing of the Personal Data if there are legitimate interests for Processing which outweigh Your interests.

About our Publishing Certificate

Please note that our Publishing Certificate means that some Processing of Your Personal Data does not have to comply with the Data Protection Rules. A consequence hereof is that the rights of data subject steaming from the GDPR are not applicable on such a Processing. If You wish to receive information about which Personal Data we Process under our Publishing Certificate, gain access to the Personal Data, to correct or delete any Personal Data, restrict our Processing of Your Personal Data or wish to object to our Processing of such Personal Data, You are welcome to contact us. Please note, however, that we are not obliged to follow the Data Protection Rules in this regard, but that we will do our best to meet Your wishes as we safeguard Your privacy.

Consent to the Processing of Personal Data

If You have consented to mailings, Car Info will from time to time send You newsletters and marketing via e-mail that we deem You may be interested in and which are in accordance with the type of mailings You have requested from us.

You decide if and when Your wish to withdraw the voluntary consent that You have given to the Processing of Your Personal Data. Please note that Your revoked consent does not affect any Processing that took place prior to the withdrawal. If You wish to withdraw Your consent, please contact us according to our contact information below or by following the link in the mailing.

To whom do we transfer Your Personal Data?

In the situations that You log in to the Website or App via Your Facebook or Google account, Your Personal Data will be Processed by Facebook and/or Google. Please note that Facebook and Google themselves are controllers for the Processing of Personal Data that occurs when You log in. This means that each company’s privacy policy is applicable to their Processing of Personal Data. In case You choose any of these login methods, we encourage You to read through Facebook and/or Google’s privacy policies to receive information about their Processing of Your Personal Data.

How do we protect Your Personal Data?

In order to protect Your personal integrity, discover, prevent, and limit the risks of a hacking attack etc., Car Info takes several technical and organisational information safety measures. Car Info also takes measures in order to protect Your Personal Data against unauthorised access, misuse, reveals, changes, and damage. Car Info ensures that access to Your Personal Data is only granted to employees who need to Process it in order to fulfil their work assignments, and that they abide by confidentiality.

Supervision and Compliance

If You are dissatisfied with how Your Personal Data has been Processed or believe that Your Personal Data has been Processed contrary to The Data Protection Rules You are welcome to contact us. You can also turn to the supervisory authority to file a complaint. The supervisory authority in Sweden is Integritetsskyddsmyndigheten. We ensure that all new employees are provided with this Privacy Policy in order to best protect Your Personal Data.

Car Info annually evaluates this Privacy Policy.

Third party’s terms and conditions

Car Info’s services may in some cases be subject to third party’s terms and conditions. Car Info is not responsible for such a third party’s use of Your Personal Data as they themselves are data controllers and responsible for the Processing of Your Personal Data. Hence, it is important that You observe and read through the terms and conditions of such third parties, i.e. when using the App or Website. The same applies if there is a link on our Website or in the App to other websites.

Changes to the Privacy Policy

Car Info reserves the right to change this Privacy Policy when we deem it to be necessary. Such changes are usually warranted upon potential changes to applicable legislation, due to statements from the supervisory authority or other authorities issuing statements pertaining to the Data Protection Rules. Further, this Privacy Policy will be updated when it is necessary due to changes in our business activities.

If Car Info makes comprehensive changes to this Privacy Policy or changes concerning how we Process Your Personal Data, You will be informed of this before such a change come into force.
